These terms and conditions apply to the use of this website (“Site”), including the purchase of goods over this Site. These terms and conditions must be read alongside other applicable terms and conditions governing the use of the Site Standard Terms of Trade (“Terms of Trade”) or any of Port of Tauranga Half participating member merchants, or our or their related companies, agents, suppliers or licensors Standard Terms of Trade (“Terms of Trade”).
Terminology
In these terms and conditions the expressions “we”, “us” and “our” are a reference to Port of Tauranga Half, or our or their related companies, agents, suppliers or licensors. Amendments to terms and conditions We reserve the right to amend these terms and conditions from time to time. Any amendments will be effective immediately upon notification on this site. Your continued use of this site following such amendments will represent an agreement by you to be bound by the terms and conditions as amended.
New Zealand Consumer Guarantees Act 1993
If you purchase Goods from us for a business purpose, then you agree that the statutory guarantees and implied terms, covenants and conditions contained in the New Zealand Consumer Guarantees Act 1993 are excluded by mutual agreement and do not apply as set out in Clause 10 of the Terms of Trade.
Disclaimer
We do not accept responsibility for any loss, damage (including direct, special, or consequential loss or damage), however caused (including through negligence) which you may directly or indirectly suffer in connection with your use of this Site or any linked website, nor do we accept any responsibility for any loss arising out of your use of or reliance on information contained on or accessed through this Site. The extent of our liability in relation to any Goods purchased over the Site is specified in Clause 11 of our Terms of Trade, and as set out below. Except as otherwise stipulated in these terms and conditions or in the Terms of Trade, we will not accept liability to you in respect of any loss or damage (including direct, special or consequential loss or damage) however caused (including through negligence) which may be suffered or incurred by you or which may arise directly or indirectly in respect of Goods supplied pursuant to an order placed on this Site or in respect of any failure or omission on our part to comply with our obligations as set out in these terms and conditions and in the Terms of Trade. To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is hereby excluded. Where legislation implies any condition or warranty, and that legislation prohibits us from excluding or modifying the application of, or our liability under any such condition or warranty, that condition or warranty will be deemed included but our liability will be limited for a breach of that condition or warranty to one or more of the following at our option (and in accordance with Clause 9 of the Terms of Trade): (a) where the breach relates to Goods: (i) the replacement of the Goods or supply of equivalent goods; (ii) the repair of such Goods; (iii) the payment of the cost of replacing the Goods or of acquiring equivalent goods; or (iv) the payment of the cost of having the Goods repaired.
Exception to disclaimer
The disclaimer set out in these terms and conditions does not attempt or purport to exclude liability arising under statute if, and to the extent, that such liability cannot be lawfully excluded.
Specific warnings
You must ensure that your access to this Site is not illegal or prohibited by laws which apply to you. You must take your own precautions to ensure that the process which you employ for accessing this Site does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. For the avoidance of doubt, we do not accept responsibility for interference or damage to your computer system which arises in connection with your use of this Site or any linked site. We make no warranty that Goods acquired from us over this Site will meet your requirements. Trade marks
Except where otherwise specified, any word or device to which the ™ or ® symbol is attached is a Trade Mark owned or licensed by us (the “Trade Marks”). If you use any Trade Marks in reference to our activities or Goods, you must seek our express authorisation and at all times comply with Clause 20 of the Terms of Trade. You must not use the Trade Marks in: (a) or as the whole or part of your own trade marks; (b) connection with activities or goods which are not ours; (c) a manner which may be confusing, misleading or deceptive; and/or (d) a manner that disparages us or our information or the Goods (including this Site).
Intellectual property
All existing or future patent, patent applications, designs, copyright, manufacturing methods, processes, know-how or other industrial or intellectual property (“Intellectual Property”) in the Goods is owned by or licensed by us, remains our property and you acknowledge that you have no right, title or interest in or claim to the Intellectual Property in accordance with Clause 20 of the Terms of Trade. You acknowledge that any improvements to the Intellectual Property discovered by you pursuant to your use of the Goods is our property and you will advise us as soon as possible and assign any such improvements to us, and we will have the sole right to apply for any patents and/or obtain any copyright protection for such improvements.
Restricted use
You are authorised to print a copy of any information contained on this Site, unless such printing is expressly prohibited. You may not however on-sell information obtained from this Site without our written permission.
Privacy Policy
Any personal information we may collect will be used by us only to respond to your inquiry or process an order. We may also use any personal information provided by you to measure the use of our site and to improve its content. At times cookies may be used to help us serve you better. A cookie is a tiny element of data sent by a website to your browser, which may then be stored on your hard drive so we can recognise you when you return. You may set your browser to notify you when you receive a cookie and, if you wish, to reject it. Email contact and how we handle emails
It is the policy of Port of Tauranga Half to send our members emails throughout the purchasing process and other newsletter emails they elect to receive. Further, it is our policy to immediately remove any member from any mailing list upon the member’s request. In addition, Port of Tauranga Half will send out promotional material to its newsletters subscribers promoting material related to Port of Tauranga Half. We do use email as a means of receiving feedback from our members, and we encourage you to email us with your questions or comments. We will preserve the content of any email you send us if we believe we have the legal requirement to do so. Your email message content may be monitored by us for trouble shooting or maintenance purposes or if any form of email abuse is suspected.
Membership Registration
Our site’s registration form requires you to provide us contact information and may also require demographic information. Your contact information may be used to contact you when necessary.
Membership Removal
If you wish to have your registration removed from our directory for any reason, simply send us an email requesting to be removed.
Updating Your Personal Information and Password Control
Port of Tauranga Half provides you with ways in which you can alter your personal data, including changing your email address, password, phone number, etc. It is your responsibility to keen this information up to date. You are responsible for all actions taken with your user name, email address and password. Therefore we do not recommend that you disclose your Port of Tauranga Half password to any third parties. If you choose to share your user name, email address and password or your information with third parties, you are responsible for all actions taken with this information and therefore you should review that third party’s privacy policy.
Security of information
Unfortunately, no data transmission over the internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information that is transmitted to us is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.
Termination of access
Access to this Site may be terminated at any time by us without notice. Our disclaimer will nevertheless survive any termination.
Governing law
The use of this Site, any contracts formed in conjunction with this Site, and these Terms and Conditions are all governed by New Zealand law. If a dispute arises between you and us it will be decided by alternative dispute resolution, or the New Zealand Courts. The only exception to this is on points of patent, trade mark, or copyright protection. Disputes involving these issues will be governed by the law of the country granting the protection.

If we waive any rights available to us under these terms and conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion. If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions will nevertheless continue in full force.
Fulton Hogan Mount Festival of Multisport TERMS AND CONDITIONS

In choosing to enter this event, I agree to the following terms and conditions: I also agree that only entries received with prior approval from the race office will be accepted. Any entries received that have not been approved by the race office will be deemed invalid.
- I acknowledge that triathlons and the individual disciplines associated with a triathlon are inherently dangerous and serious accidents can and often do happen which may result in injury. I verify that I am physically fit and have sufficiently trained for this competition. I agree to participate at my own risk.
- I acknowledge that the event organiser reserves the right to accept or decline entries and issue any special invitations in its sole and absolute discretion. However, entry numbers are limited, and any entries received after the limits have been reached will not be accepted.
- I agree that in the event of an event cancellation due to conditions beyond the control of the organisers including but not limited to a storm, rain, inclement seasonal weather, winds, “Acts of God”, “Acts of Terrorism”, infectious disease pandemic (for example, COVID 19) , or other conditions, my entry fee shall be non- refundable.
- I acknowledge that it may become necessary or desirable to change the format of the event due to circumstances beyond the control of the organisers. In the event of a change to the format of the event (including, but not limited to, a virtual race) I agree to the changes and that all of the terms and conditions set out herein shall apply to the changed event.
- I agree to comply with all the event rules, regulations, and instructions in respect of this event and as notified to me in the entry information or otherwise by the event organisers and officials. I acknowledge that the Triathlon NZ Competition Rules and age group guidelines apply to the Triathlon and Aquabike events, including teams, and declare that I have read and understood those rules.
6. Refunds: I agree to pay such fees as the organiser may charge for this event. I accept that I will be eligible for a refund if I have pre-purchased the Race Roster ‘Enhanced Refund Protection’. I understand that all refund requests are handled directly through Race Roster. I understand and accept that if I do not pre-purchase the ‘Enhanced Refund Protection’ upon entering, I am not eligible for a refund under any circumstance.
7. Transferring your entry to 2026: The organisers may, at their discretion, grant a transfer to the following year based on individual circumstances for cases of injury or illness only. A medical certificate will be required in order to grant any transfers. From December 1st 2024, any accepted transfer requests will incur a $50 admin fee. I agree to pay such fees as the organiser may charge for this event. I accept that these fees are non-refundable in any circumstances. I accept and understand that no transfers will be accepted from January 13th 2025 (event week). I understand that I can only transfer my entry once and any further transfer requests will not be accepted.
8. Transferring your entry to another participant: The organisers may, at their discretion, grant a transfer of my entry to another person, based on individual circumstances. Any accepted transfer requests will incur a $50 admin fee for the Tauranga Half and AquaBike. Any accepted transfer requests will incur a $20 admin fee for the Mount Festival Half Marathon. I agree to pay such fees as the organiser may charge for this event. I accept that these fees are non-refundable in any circumstances. I understand that I will be responsible for finding a participant to take over my entry. I understand that I am only able to do so prior to January 13th 2025 (event week) and that requests from this date will not be accepted. I understand that I can only transfer my entry once and any further transfer requests will not be accepted.

9. Transferring between events: The organisers may, at their discretion, grant a transfer between events of my entry, based on individual circumstances. Transfer requests must be submitted prior to January 13th 2025, and no transfers are allowed under any circumstances from January 13th 2025 (event week).
Mount Festival Half Marathon: Participants may transfer between the 5km, 10km, and 21km event distances as they wish. I understand that if I wish to transfer up to an event, I am required to pay the difference. I understand that if I wish to transfer down to an event that no refund will be given. I agree to pay such fees as the organiser may charge for this event and I accept that these fees are non-refundable in any circumstances. I understand that I can only transfer my entry once and any further transfer requests will not be accepted.

Tauranga Half & AquaBike: I understand that if I wish to transfer to a different event (ie. from the Tauranga Half to the AquaBike or vice versa), that I must get in touch with the event organisers to process. I understand that if I wish to transfer up to an event, I am required to pay the difference. I understand that if I wish to transfer down to an event that no refund will be given. I understand that it is then my responsibility to re-enter into my new event as per the organisers transfer instructions. I agree to pay such fees as the organiser may charge for this event and I accept that these fees are non-refundable in any circumstances. I understand that I can only transfer my entry once and any further transfer requests will not be accepted.
- I accept that the information gathered from this event (including my entry form details) will be used to administer the event and may be used to promote and market future events. I understand that my details may be passed onto third parties (i.e. sponsors) for promotional purposes relating to the event. I give permission for the use of my picture for any promotional material for this event or future events. I understand that information about my registration may be made available on the www.mountfestival.kiwi site and elsewhere if the event organiser allows it.
- I (for myself and, where applicable, on behalf of my legal guardian, successors, executors and trustees) release and hold harmless the event owners, organisers, directors, officials, sponsors, promoters, suppliers, local authorities, volunteers and all other persons associated with the event (“the organisers”) from any and all liability, claims, actions and causes of action whatsoever arising out of or relating to any loss, damage, or injury that may be sustained by me in connection with my entry and/or participation in this event. I (for myself and, where applicable, on behalf of my legal guardian,
successors, executors, and trustees) fully indemnify the organisers against any such liability, claims, action or causes of action. I understand that this waiver and indemnity extends to any and all liability, whether arising through the negligence, action, or inaction of any of the organisers, or otherwise.
- The organisers may make use of SMS text messages to inform competitors of any race updates or provide information pertinent to competitors. Any messages received shall be free for the recipient. I hereby agree to receive text messages from the race organisers pertaining to this event.
- I acknowledge that to enter this event as an individual the following minimum age restrictions apply:
- ● Tauranga Half – must be 18 years of age as at 31 December in the year of competition. Entrants under 18 may be accepted at the discretion of the Triathlon New Zealand Technical Delegate and exemption. must be applied for in writing prior to 1st December 2024.
- ● Aquabike – must be 18 years of age as at 31 December in the year of competition. Entrants under 18 may be accepted at the discretion of the Triathlon New Zealand Technical Delegate and exemption must be applied for in writing prior to 1st December 2024.
- ● Mount Festival Half Marathon 21 km – must be at least 16 years of age on event day
- ● Mount Festival Half Marathon 10km – All participants under the age of 10 must be accompanied by an adult for the entire duration of the event and the accompanying adult takes full responsibility for the safety of the entrant 10 years or under. Participants over the age of 10 can complete the event without an adult accompanying them. Maximum of 2 children per adult.
- ● Mount Festival Half Marathon 5km – No age restrictions. All participants under the age of 5 must be accompanied by an adult for the entire duration of the event and the accompanying adult takes full responsibility for the safety of the entrant 5 years or under. Maximum of 2 children per adult.
- MINORS: Where any entrant is a minor, that entrant’s entry form must be completed by a guardian who must also accept these terms and conditions on behalf of the entrant.

a team, I certify that I accept these terms and conditions both personally and for and on behalf of my teammates. If I am submitting this entry form on behalf of a minor (see clause 13) I certify that I accept these terms and conditions on behalf of the entrant.
